Terms and Conditions

These Terms and Conditions (“Terms”) govern the provision of services by Smally Digital (“we”, “us”, or “our”) to any individual or business (“client”, “you”, or “your”). By making a purchase or submitting payment, you agree to these Terms.

1. Services

Smally Digital provides various digital services, including but not limited to:

• Website design and development
• Website hosting
• Domain management and DNS services
• Google Business Profile management
• Business email services
• eCommerce solutions

By engaging our services, you acknowledge that you are purchasing specific offerings as outlined in your selected package or agreement. These Terms apply to all services, whether purchased individually or as a bundle.

2. Payments and Refund Policy

• All payments are final and non-refundable.
• We reserve the right to issue refunds at our sole discretion. If a refund is granted, the refunded amount will be less any payment processing fees incurred.
• Payment must be made in full before work commences unless otherwise agreed in writing.
• Any additional services requested beyond the initial agreement may incur extra charges.

3. Website Design & Development

• All website design and development projects require a 50% deposit before work begins, with the remaining balance due upon project completion.
• The client is responsible for providing all necessary content, including text, images, and branding materials, unless otherwise specified.
• Once the final design is approved, any further revisions may incur additional charges.
• We are not responsible for delays caused by the client’s failure to provide required materials in a timely manner.

4. Website Hosting

• Hosting fees are billed in accordance with the selected package.
• We use enterprise-grade cloud servers located in Australian data centres to ensure fast and reliable hosting.
• While we aim for 99.9% uptime, we are not responsible for outages caused by third-party providers, maintenance, or unforeseen circumstances.
• The client is responsible for maintaining backups of their website content unless otherwise agreed in a hosting plan.

5. Domain Management & DNS Services

• We provide domain registration, renewal, and DNS management services to optimise website performance.
• Clients remain the legal owner of any domain name registered on their behalf.
• Failure to renew a domain before expiry may result in loss of ownership, for which we accept no liability.

6. Google Business Profile Management

• We optimise and manage Google Business Profiles to enhance local search visibility.
• We do not guarantee specific ranking positions in Google search results.
• Clients must provide accurate and verifiable business information for listing approval.

7. Business Email Services

• We provide secure email hosting solutions, with service availability dependent on third-party infrastructure.
• Clients are responsible for maintaining access credentials and ensuring compliance with usage policies.

8. eCommerce Solutions

• Our eCommerce websites are developed using WooCommerce and can be customised as per the selected package.
• Clients are responsible for ensuring compliance with Australian consumer laws regarding online sales.
• We do not provide ongoing management of online stores unless included in a separate maintenance agreement.

9. Limitation of Liability

• We are not liable for any direct, indirect, incidental, or consequential damages arising from the use of our services.
• While we take every precaution to provide reliable and secure digital solutions, we do not guarantee uninterrupted service or specific business outcomes.

10. Amendments & Termination

• We reserve the right to update these Terms at any time. The latest version will always be available on our website.
• We may terminate services if a client violates these Terms, fails to make payment, or engages in abusive or fraudulent behaviour.

11. Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any disputes shall be resolved in accordance with the legal jurisdiction of NSW.

12. Acceptance of Terms

By making a purchase or submitting payment, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.
